Consent(Required) I have read and agree to all of the following:
1. We acknowledge receiving the above-described animal.
2. We will provide proper care for this animal, including adequate food and water, safe and comfortable shelter, proper animal containment, nutritional support, adequate exercise, animal enrichment, socialization, and humane treatment for all animals. We will also provide any veterinary care necessary, including vaccinations, routine preventative care, and treatment of injuries or illness.
3. We understand that the animal may have been exposed to, be carrying, or have a contagious disease. We agree to keep the animal separate from all other animals and take reasonable hygiene precautions for a minimum of the next fourteen (14) days.
4. We agree that transferred animals will not displace other animals in our care or in our community.
5. We agree that this animal, once transferred into our care, will not be euthanized for space.
6. The transferred animal will not be used for malicious purposes like breeding, fighting, or commercial sale.
7. We agree not to allow the animal to be used for medical or any other experimental purposes.
8. Transferred animals are sterilized prior to adoption unless not medically eligible (as dictated by a licensed veterinarian).
9. We will assume legal ownership of any animal transferred to us upon arrival of the transport or pick up from the shelter.
10. Our organization shall be fully liable for all costs for the care and damage done by the animal during the time our organization has assumed ownership of the animal.
11. We agree to always keep the best interest of the animal and public in mind while making health and welfare decisions. This includes humanely euthanizing animals in the case of physical or mental suffering or when they pose a danger to the public.
12. We understand that most animals have an unknown history and have been in a shelter environment. Therefore, West Valley Humane Society is not able to ensure that any animal has not been exposed to any viruses, bacteria, parasites, or pathogens.
13. We understand that WVHS cannot guarantee the temperament of an animal. All information known to WVHS will be disclosed as part of the transfer process. If the animal exhibits dangerous, temperamental, or aggressive behavior after leaving the shelter, WVHS is not responsible nor liable.
14. Transferring an animal into our organization's care is at our own risk, and we assume all legal liability. We understand that animals may have differing behavior outside of the shelter, which cannot be predicted by shelter staff. We agree that we will hold WVHS harmless of all liability in the case of injury of the animal, another animal, or to a person.
15. We understand that WVHS will not be held responsible for any debt incurred for medical expenses or any other type of debt or payment or payments incurred for the services of private veterinarians for the above-described animal.
16. We understand that WVHS is no longer responsible for any liability or other insurance coverage for this animal and that any/all incidents that may occur after the legal transfer of this animal out of WVHS is the sole responsibility of the agency/facility/rescue that has signed this agreement. We understand that it is in our best interest and is our responsibility to provide liability insurance for the animals in our care, if we so choose, and will not hold WVHS responsible for any continued insurance coverage obligations once the animal is in our care.
17. We accept the animal at our own risk and agree that no promises or guarantees have been made to us regarding the health of the animal, nor its behavior, age, breed, or habits.
18. We agree to defend, indemnify, and hold harmless West Valley Humane Society and any of its Board, Agents, Employees, Assigns, and Successors in Interest from and against all suits and causes of action, claims, losses, demands, and expenses. Including, but not limited to attorney's fees, and cost of litigation, damage, or liability of any nature whatsoever, for the death or injury to any person, including our employees and agents or damage or destruction of any property of either party hereto or of third parties, arising in any manner by reason of the negligent acts, errors, omissions, or willful misconduct incident to our performance under this agreement. The provisions of this paragraph survive expiration or termination of this agreement.
